Hace no mucho tiempo, todo se veía prometedor para EPIC, ya que a pesar que tenia que pagar la multa, en cierto modo, le gano la demanda a Apple, pero la historia no terminó ahí.
Debido al incumplimiento de contrato por parte de EPIC hacía Apple, este no tiene la obligación de restaurar la cuenta de desarrollador de EPIC en la App Store si no quiere hacerlo.
Tim Sweeney, CEO de EPIC, envió una carta a Phil Schiller, de Apple, indicando que pago los 6 millones de dolares de multa dicho por la corte y prometió adherirse a las pautas de Apple a cambio de que su cuenta de desarrollador sea restaurada para poder llevar Fortnite de regreso a MAC e iOS.

Apple rechazó la solicitud.
Epic cometió un incumplimiento intencional de contrato y abuso de confianza al ocultar el código a Apple y realizar tergiversaciones y omisiones relacionadas. En su decisión, el tribunal reconoció que Apple tenía derechos contractuales para actuar como lo hizo. Simplemente hizo cumplir esos derechos como los propios documentos de Epic muestran que Epic Games esperaba.
El tribunal además encontró que la terminación del Acuerdo de Licencia del Programa para Desarrolladores por parte de Apple y los acuerdos relacionados entre Epic Games y Apple eran válidos, legales y ejecutables. Luego de esa decisión, el Sr. Sweeney ha dicho públicamente que no cambiaría su sistema de pago alternativo para poder tener a Fortnite nuevamente en iOS.
Mientras tanto, Tim Sweeney mencionó sobre la decisión de Apple como “Una medida extraordinariamente anticompetitiva”, “Una perdida para la competencia justa y la elección del consumidor” y acusó a Apple de mentir sobre el regreso de Fortnite a la App Store a cambio de cumplir las reglas.

Finalmente, la corte declaró que Apple tiene toda la autoridad legal de mantener a Epic fuera de la App Store. Por su lado, Epic advirtió que el proceso de agotar todas las apelaciones en el caso podría demorar incluso hasta 5 años.
